Copyright Confusion
Educators are beginning to make active use of copyrighted materials to promote critical thinking and communication skills using Web 2.0 and social media tools. Yet many educators are confused about their rights to use copyrighted materials under the fair use doctrine.Renee Hobbs of Temple University, along with Pat Aufderheide and Peter Jaszi of American University and with support from the John D. and Catherine T. MacArthur Foundation are helping to address the problem of copyright confusion among K-12, youth media, and university educators. Hobbs and her colleagues conducted in depth interviews with 63 media educators and discovered that confusion about copyright and fair use had a negative effect the quality of teaching and learning. The results of these interviews were published in The Cost of Copyright Confusion for Media Literacy.The Statement of Best Practices in Fair Use for Media Education will be released in November and will be endorsed by a number of educational groups, including The National Association for Media Literacy Education and others. The Statement will help bring clarity to the problem of copyright confusion by clearly identifying four common educational practices that rely on the use of digital copyrighted materials for educational use as qualifying for the fair use exemption. Come discuss what educational uses of copyrighted materials were considered normative practices in the field and qualified for protection under the doctrine of fair use and add your thoughts. The themes for the discussion will include the importance of transformativeness (adding value to copyrighted works or re-purposing); the importance of attributions; and the circumstances when widespread sharing of created works that incorporate copyrighted material. How will this change what you do in your classroom when it comes to digital media?
